The website located at www.pestonifamily.com (the “Site”) is owned and operated by Pestoni Brothers, LLC, doing business as Pestoni Family Estate Winery (“Pestoni Family Estate Winery,” “we,” or “us”). The following Terms and Conditions (“Terms of Use”) govern your access to and use of the Site. By using the Site, you agree to comply with and be bound by these Terms of Use and our Privacy Policy.

We reserve the right to modify or update these Terms of Use at any time, with or without notice, and such changes will be effective immediately upon posting. It is your responsibility to review these Terms periodically.

Permitted Users
The Site is intended for individuals who are of legal drinking age in their country of residence. By using this Site, you affirm that you are of legal age to purchase and consume alcohol in your jurisdiction. If you are not of legal age, please exit the Site immediately.

Intellectual Property

All trademarks, service marks, and trade names used on the Site are owned by Pestoni Family Estate Winery or its licensors. You may not use any of these without prior written consent, except as permitted by applicable law.

Use of Materials and Site Restrictions

Text Messaging Privacy

We reserve the right to terminate your access at any time, with or without cause, and without notice.

Governing Law
These Terms are governed by the laws of the State of California. All disputes shall be resolved exclusively in the state or federal courts located in Napa County, California.

WINE CLUB TERMS & CONDITIONS
(“Club Terms”)

Membership & Acceptance
By enrolling in the Pestoni Family Estate Winery Wine Club (the “Club”), you agree to be bound by these Club Terms. No verbal or other statements shall alter these Terms unless agreed upon in writing.

Shipping & Delivery
We ship four times per year, typically in March, May, October, and December. Shipping availability and fees vary by state and are subject to change. You must be at least 21 years old to receive shipments, and an adult signature is required upon delivery.

In the event that legal restrictions prevent us from shipping to your address, you may opt to change your membership to pickup or cancel it. Refunds will be issued for any unshipped paid wine due to such legal constraints.

We are not responsible for weather-related damage and may delay shipments during extreme weather.

Pick-Up Members
Wines must be picked up within 90 days of billing. If not, and no alternative arrangements are made, your wine will be shipped to your billing address at your expense.

Billing & Updates
Your credit card will be charged automatically four times per year. It is your responsibility to update billing, shipping, and credit card information at least five (5) business days prior to each billing cycle.

Once processed, all sales (including tax and shipping) are final and non-refundable.

Cancellation
To cancel your membership, you must notify us in writing at least 14 days prior to the upcoming billing cycle by emailing hospitality@pestonifamily.com. Fees already charged are non-refundable.

We reserve the right to cancel your membership at our discretion.

Privacy and Personal Data
Your personal information is collected and used in accordance with our Privacy Policy. If you are located outside the U.S., you consent to the transfer of your data to our U.S. servers.

Disclaimer & Liability
ALL CLUB GOODS AND SERVICES ARE PROVIDED “AS IS.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR CLUB MEMBERSHIP OR CLUB PRODUCTS.

Compliance & Age Restriction
Membership is void where prohibited. Wines are intended for personal use and not for resale. By joining, you certify that you are at least 21 years old. Valid ID will be required upon delivery or pickup.

Modifications
We reserve the right to update these Club Terms at any time. Continued participation after updates signifies your acceptance.

Gift Card Terms
Pestoni Family Estate Winery gift cards may be redeemed for wine, tastings, or merchandise in the tasting room or online where permitted by law. Not redeemable for cash except as required by law. Gift cards do not expire and carry no maintenance fees. Lost or stolen cards may be replaced with proof of purchase.
